Terms & Conditions (Online and In-studio)

Below is our Rental Agreement. This applies to all rental items booked through The NŌA Rental website, AND booked out at our studio at Unit E506 (5th floor, Sami.G Office Square, 80 Greenvale Rd, Bedfordview, Germiston, 1401, unless otherwise specified.

CONTRACT

By placing an order on The NŌA Rental website OR at our studio at 6 Park Street, Bedfordview that contains any items that are for rent, you are entering a legally binding contract between yourself and The NŌA Rental.

PAYMENT

By entering this agreement, you authorise The NŌA Rental to charge the selected payment method according to the terms outlined in this agreement. You certify that you are authorised to use this credit card/account and you agree not to dispute the payment with your provider if The NŌA Rental fulfils its responsibilities in providing the rental item(s).

You also authorise The NŌA Rental to charge the supplied payment method for any additional fees as outlined in this agreement (such as damages or late return fees). If a charge against the supplied payment method cannot be made, we will provide you with an invoice for the fees which you agree to pay within 5 working days.

If for some reason, your payment for an order is reversed or rejected, you agree to pay the outstanding amount within 48 hours of demand. Failure to do this will result in immediate cancellation of the booking. If the item(s) have already been dispatched you will still be liable for the full amount.

We may ask you to either pay a deposit to cover any possible Late Fees, Replacement Fees or Administrative Fees, or to provide credit card details to keep in case we need to charge these fees to you. If you have provided us with your credit card details then you authorise us to debit your card with any Late Fees, Replacement Fees or Administrative Fees payable in terms of the Terms and Conditions.

The NŌA Rental reserves the right to take all steps necessary to recoup any amounts owing as per this agreement, including the use of debt collection agencies and taking legal action. This may increase the amount owed by the customer, to cover the costs of these services.

Payment Options Accepted

Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into The NŌA Rental (Pty) Ltd bank account, the details of which will be provided on request.

 Card acquiring and security

Card transactions will be acquired for The NŌA Rental (Pty) lTD via PayFast (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayFast uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.payfast.co.za to view their security certificate and security policy.

Card transactions will be acquired for The NŌA Rental (Pty) at our studio at Unit E506 (5th floor, Sami.G Office Square, 80 Greenvale Rd, Bedfordview, Germiston, 1401 via a Yoco machine.

Customer details separate from card details

Customer details will be stored by The NŌA Rental (Pty) Ltd separately from card details which are entered by the client on DPO PayFast’s secure site.

Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

The NŌA Rental (Pty) Ltd takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website and in our studio at 6 Park Street, Bedfordview, customer service and support, dispute resolution and delivery of goods.

Country of domicile
This website is governed by the laws of South Africa and The NŌA Rental (Pty) Ltd as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

IDENTIFICATION

In some cases, after you’ve placed an order via our website or at our studio at Unit E506 (5th floor, Sami.G Office Square, 80 Greenvale Rd, Bedfordview, Germiston, 1401, you may be asked for a passport, driver’s license or other forms of identification. If this isn’t provided, The NŌA Rental reserves the right to refuse the booking.

TITLE TO RENTAL ITEMS

At all times, the rental items are and remain the property of The NŌA Rental. The NŌA Rental reserves the right to retrieve the item/s at any time.

BOOKING PERIOD

The rental period you have selected for your rental is ‘inclusive’. For example, a 4-day rental period can mean that your item will arrive by Friday and you will post it back on Monday. In this example, both the Friday and the Monday are included in the 4-day period.

DELIVERY

It is your responsibility to be available at the delivery address provided at the time provided when you made the Hire. The Hire Period will run and we are entitled to charge extra delivery fees if you do not meet the courier at the agreed delivery location at the agreed time.

Bookings SHOULD be made two days before your desired Hire period start date.

On The NŌA Rental , you are asked to select a “Delivery Date”. You should select a Delivery Date which is 1 or 2 days before the day you intend to wear the item(s).

In the majority of cases, your item(s) will arrive on or before your Delivery Date (sometimes referred to as the “Arrives by” date). Due to unforeseen circumstances, usually related to issues with the courier it may arrive 1 or 2 days later.

No refund or credit will be offered in this instance unless the item arrives too late for you to wear it for your planned event. If your order was placed 3 or more business days prior to your chosen delivery date, it will be a full refund (please see Definition of Refund section below). Otherwise it will be considered a “last-minute order” and you will receive a credit for the full amount of the Hire Cost to use at The NŌA Rental. .

You will receive a tracking number to your supplied email address when the items have been dispatched. If you haven’t received this 1 day prior to your selected Delivery Date (or by your selected Dispatch Date), feel free to get in touch.

If your delivery fails because you have provided an incorrect or incomplete address, you will not be entitled to a refund or credit. It is your responsibility to ensure that the address you entered is accurate and complete. This includes providing a valid apartment/unit number, company name or any other information required for courier providers to deliver to you.

Please Note: If you have selected the ‘pick-up’ option for your dress rental, you are responsible for your rental item once it is collected from the studio, whether it is collected by you, a friend, another collection service or an Uber Connect. The NŌA Rental will not be held responsible for any loss, theft or damage caused once the rental is collected from our studio. The NŌA Rental is not responsible for collection costs. If you have selected the courier option for your dress rental and for any reason you are not available at the collection address for the courier to collect, you are responsible to return the rented item to the studio in a timely manner, whether it be returned by you, or someone else, another courier service or Uber Connect. The NŌA Rental will not be held responsible for any loss, theft or damage caused due to your alternative choice of return for your rented item to our studio or agreed upon location.

INCORRECT OR FAULTY ITEMS

If you open your delivered parcel to find that you have been sent the incorrect item, please let us know immediately. If there’s enough time, we will do our best to get you a replacement so you still have something to wear.

If you find that the item is correct, but has other issues (e.g. damage, faults or noticeable stains), please let us know within 24 hours of receiving the item, and definitely prior to wearing the item.

If you don’t let us know within this timeframe, we reserve the right to refuse a refund as it will not be clear when the damage was caused or by who. You should do this even if you believe you will still wear the item, as you may be offered a discount. More importantly, it will mean you won’t be blamed for the damage or charged damage fees.

Please note that our rental dresses have been cherished and worn by many, so they may not be in brand new condition, but they carry the charm of past celebrations.

You acknowledge that the items being sent to you are not brand new and may have some signs of wear & tear. A refund may not be granted if the issue is considered minor or insignificant.

In most cases, you will need to wait for the item to be returned to The NŌA Rental and assessed, prior to a refund being approved and processed. If approved, you will receive a full refund excluding any amount paid for courier.

ISSUES WITH FIT OR APPEARANCE

If the Clothing does not fit you must notify us within 4 (four) hours of accepting the delivery.

You can either request another size (subject to availability) or return the garment. If you notify us of your sizing issue within 4 (four) hours of receiving the garment and you wish to return the garment instead of request another dress, you will be issued with a refund, minus the delivery fee. Either way we are entitled to charge you the Administration Fee.

If your booking entitles you to a gift-card, it will be issued with a 6 month expiry.

CUSTOMER CANCELLATIONS

In the event of cancellations less than 30 days before the hire period, the booking fee is non refundable, however you will receive a credit for the full amount of the Hire Cost to use at The NŌA Rental.  You will receive a full refund should you cancel 30 or more days before the start of the hire period. No Refunds will be made on items that are kept for the hire period regardless if worn or not.

Unless otherwise specified, if you are entitled to a credit note for your cancellation, it will be issued with a 6 month expiry.

CANCELLATIONS BY THE NŌA RENTAL

The NŌA Rental may cancel your booking, for any reason. The compensation to you will be limited to the amount you paid to The NŌA Rental for the booking and courier fee. The NŌA Rental will not be responsible for any consequential damages that result from cancellation of the booking.

Reasons The NŌA Rental may cancel your booking include, but are not limited to:

  • The item is damaged by a customer that has rented the item prior to you.

  • The item is lost or stolen by a customer that rented the item prior to you.

  • It is deemed that it is not possible to deliver the item to you in time for your booking, due to previous late return by a customer, or for any other reason, such as courier delays.

In all cases above, you will be entitled to a full refund.

EXTENDING THE HIRE PERIOD

You can request an extension of the Hire Period by emailing asap, before the end of the Hire Period. We have the right in our sole discretion to refuse extensions of the Hire Period.

We will send you a new email with all the necessary details, including the new Hire Cost.

RETURN OF ITEMS

All items rented via The NŌA Rental will be delivered with a return courier satchel for returning the item back to us. If you don’t receive this, please let us know ASAP.

If you lose the prepaid satchel, you will need to pay for return postage yourself via Aramex. Get in touch to let us know you’ve done this and include the tracking number.

Items will be picked up by our courier from the same address to which the time was delivered at the start of the hire period. The courier will collect your items on the day that is labelled the “Return on” date during checkout and in your order confirmation email.

If your “Return on” date falls on a Sunday or a public holiday, the item will be collected on the next working day.

Items rented from our studio at Unit E506 (5th floor, Sami.G Office Square, 80 Greenvale Rd, Bedfordview, Germiston, 1401 need to be returned in studio. 

Please Note: If you have selected the ‘pick-up’ option for your dress rental, you are responsible for the return of your rental item to the studio, whether it is returned by you, a friend, another delivery service or an Uber Connect. The NŌA Rental will not be held responsible for any loss, theft or damage caused by your choice of return service. The NŌA Rental is not responsible for return costs. If you have selected the courier option for your dress rental and for any reason you are not available on the stipulated collection date and at the provided collection address for the courier to collect, you are responsible for returning the rented item to the studio in a timely manner, whether it be returned by you, someone else, another courier service or Uber Connect. The NŌA Rental will not be held responsible for any loss, theft or damage caused due to your alternative choice of return for your rented item to our studio or agreed upon location.

CLEANING

We know small accidents happen, The NŌA Rental dry-cleans all garments when they are returned after your rental. There will be no fees charged as long as stains can be removed.

You agree that under no circumstances will you attempt to clean the rental item(s) yourself, or have them cleaned by anyone else.

If you attempt to clean a garment and cause damage, or cause a stain to be permanent, The NŌA Rental reserves the right to bill you a fee up to, but not more than 150% of the full RRP of the garment. The garments available on our website, in most cases, were subject to customs fees to bring them into South Africa and these garments available for rent on our website are often sold out in all retail stores and no longer available from the designer, which is why a charge above the RRP may apply. This fee will be on top of any amount already paid for rental or courier fees.

Use of fake tan is at your discretion. If it causes permanent staining that won’t come out when dry-cleaned, the damage policy below will apply.

DAMAGE OR LOSS

If damage (stains, rips, etc) is observed when your garment arrives, please take photos of this and let us know right away. If you don’t do this and there was no known damage prior to delivery, it may be assumed that the damage was caused by you.

If you damage a rental item, do not attempt to repair it. If it can be easily repaired (e.g. sewing on a button, re-stitching) it will be taken care of with no additional cost to you. It’s also not a problem if the garment is stained, as long as it comes out when it is dry-cleaned after you’ve returned the garment.

You agree that under no circumstances will you attempt to clean the rental item(s) yourself, or have them cleaned by anyone else. Do not cut, alter or hem tape any item booked via The NŌA Rental.

If an item is damaged and is not covered by minor repairs as mentioned above, you will be liable for the cost of restoring or replacing the garment. In the case the garment cannot be restored to a suitable condition, the fee charged may be up to, but not more than 150% of the original RRP of the garment. This fee will be on top of any amount already paid for rental or postage, and the item will still need to be returned to The NŌA Rental, regardless of the amount of damage. The garments available on our website, in most cases, were subject to customs fees to bring them into South Africa and these garments available for rent on our website are often sold out in all retail stores and no longer available from the designer, which is why a charge above the RRP may apply. This fee will be on top of any amount already paid for rental or courier fees.

If you’ve lost or not returned an item, you will be liable for up to 200% of the RRP of the item.

The items available for rent on our website are often brought in from overseas or sold out in all retail stores and no longer available from the designer. This has led to some people renting an item and not returning it, saying it is lost or causing slight damage, enough to constitute a charge for replacement, so that they are able to obtain something they want to keep. This, along with loss of earnings from potential future rentals, is why there is a 150% – 200% of RRP fee for damaged, lost and unreturned items. It is due to the reasons listed above that damaged rentals will not be returned to the renter once damage fees have been paid.

If an item is lost by the courier, then there will be no fees charged to you. Please ensure to keep your proof of return waybill signed by the courier upon collecting the item from you so that there will be a record of you returning the item in their tracking system. Without this there will be no evidence of you having returned the item, meaning you would be liable for the loss.

By accepting this agreement, you give permission for The NŌA Rental to charge fees for damages or loss of an item to the payment method you used when placing your order either online or at our studio. You will be given the option of using an alternative payment method before the charge is made.

LATE RETURN

If for any reason you are not available to return the rental item(s) on a day that the courier is scheduled to collect, late fees may apply. We will often allow a grace period of 1-2 days for this, but only if it doesn’t affect a future booking for another customer. If it does affect this, late fees will almost certainly be enforced.

The fee charged for each day late will be 50% of the rental fee. For example, if your  rental fee was R499.00, late fees would be charged at R249.50 for each day late.

By accepting this agreement, you give permission for The NŌA Rental to charge late fees to the payment method you used when placing your order on our website or at our studio at 6 Park street, Bedfordview. You will be given the option of using an alternative payment method before the charge is made.

LIMITATION OF LIABILITY

By accepting the rental agreement, you agree that The NŌA Rental will not be liable for any loss, damage, costs or expenses of an indirect or consequential nature incurred or suffered by you as a result of:

  • Cancellation of a rental booking

  • Late delivery of a rental item

  • Non-delivery of a rental item

  • An issue with the quality of a delivered rental item

This includes but is not limited to economic loss, loss of goodwill, emotional suffering, loss of opportunity or other loss of turnover, profits or business.

The NŌA Rental’ liability will be limited to any amount paid by the customer to The NŌA Rental.

DEFINITION OF “REFUND”

For the purposes of this agreement, a refund for an order is defined as returning back to you the initial form of payment used to place that order. If you paid for the order by credit/debit card, the funds will be returned to that card. If you paid for the order using a credit note, then you will be re-issued that credit note, with a fresh expiry date. For orders placed using a combination of multiple forms of payment, you will receive back those forms of payment in line with the amounts used to pay for the order.

CHANGES TO THE RENTAL AGREEMENT

The NŌA Rental reserves the right to change the Rental Agreement at any time, so it is important you review them each time you place an order with The NŌA Rental.

The terms that apply to an order will be in accordance with the Rental Agreement as they stood on the date the order was placed.
